Terms of Service

These Terms of Service (“Terms”) apply when you use PersonalizedCatGifts.com (the “Site”) or place an order with Personalized Cat Gifts (“we”, “us”, “our”). By using the Site or placing an order, you agree to these Terms. Please read them together with our Shipping Policy, Returns & Refunds, Privacy Policy and Editorial & Content Policy, which are part of these Terms.

1. Who can order

You must be at least 18 years old, or the age of majority where you live, to place an order. If you’re younger, you may use the Site only with a parent or guardian who agrees to these Terms. Products are sold for personal use and may not be resold.

2. Orders, prices and payment

• Your order is an offer to buy. We accept it when we send you an order confirmation email. We may decline or cancel an order, with a full refund, if a product is unavailable, a price or description was clearly wrong, we suspect fraud, or the order breaks section 4.
• Prices are in US dollars. Standard shipping to the US addresses listed in our Shipping Policy is free. Sales tax is added at checkout where it applies.
• We work to keep prices and product information accurate. If we find an error after you order, we’ll contact you, and you can continue at the correct price or cancel for a full refund.
• You can pay with PayPal or with a debit or credit card. Payments are processed securely by our payment provider, PayPal, and we never see or store your full card number. You confirm that you’re authorized to use the payment method you provide.
• Discount codes have their own conditions, have no cash value and can’t be combined unless we say otherwise.

3. Personalized products and the AI preview

• Every item is made to order from the photo, text and options you provide. Please check your photo, spelling, size and color carefully before ordering. We print the text exactly as you enter it.
• The free AI preview on a product page is an illustration only. It is created automatically and helps you see the design idea. Our designers prepare the final artwork from your original photo, which may include removing the background, refining the outline and adjusting color and brightness. We don’t change your cat’s markings or invent missing details.
• Free previews may be limited per visitor per day, and we may change, limit or pause the preview tool at any time.
• Product images on the Site show our designs with example cats and are created with AI tools and editing software (see our Editorial & Content Policy). Your item is printed from your own photo, so colors, brightness and details may differ a little from the preview and product images, and measured sizes can differ slightly from the listed size.
• If we believe your photo won’t produce a good result, we’ll contact you before printing. Production pauses until we hear from you, and you may cancel for a full refund at that point.

4. Your photos and content

• You keep ownership of the photos and text you upload.
• You give us a limited, non-exclusive, royalty-free license to use, copy, edit and print your photos and text only as needed to create your preview, make, ship and support your order, including sharing them with our production partner and the service providers described in our Privacy Policy. We won’t use them in our marketing without your separate permission.
• You confirm that you own the photos you upload or have permission to use them, and that your order doesn’t infringe anyone else’s rights (for example, a professional photographer’s copyright or a person’s right to their own image).
• We may refuse or cancel, with a full refund, any order with content that is illegal, hateful, sexually explicit, violent or harassing, or that uses trademarks, characters, logos or artwork you don’t have the right to use.
• If you post a product review (including photos), you give us a non-exclusive, royalty-free, perpetual license to show it on the Site with the name you provide. You can ask us to remove your review at any time.
• If you send us ideas or feedback, we may use them without any obligation to you.

5. Shipping, title and risk of loss

Delivery times are estimates. Title and risk of loss pass to you when we hand your order to the carrier, but we’ll still help you with late, lost and damaged packages as described in our Shipping Policy and Returns & Refunds policy.

6. Cancellations, returns and refunds

Because our products are personalized, we don’t accept returns or exchanges for a change of mind. You can cancel or change an order within 12 hours of placing it. Damaged, defective, incorrectly made or lost items are remade or refunded as described in our Returns & Refunds policy.

7. Our content and intellectual property

The Site and its content, including text, product images, blog images, illustrations, designs, logos, the Personalized Cat Gifts name and our personalization and preview tools, are owned by Personalized Cat Gifts or our licensors and are protected by intellectual property laws. You may view the Site and share links to it for personal, non-commercial purposes. You may not copy, download, reproduce, modify, distribute, sell or use our content for commercial purposes, including in other stores, marketplaces, advertisements, print-on-demand listings or AI training datasets, without our written permission.

8. Acceptable use

When using the Site, you agree not to: break any law; infringe anyone’s rights; upload malicious code; try to access accounts, systems or data that aren’t yours; scrape, crawl or copy the Site by automated means (other than standard search engine indexing); misuse or overload the preview tool; interfere with the Site’s security or performance; place fraudulent orders; or post false, misleading or abusive reviews or messages.

9. Copyright complaints (DMCA)

We respect intellectual property rights. If you believe content on the Site infringes your copyright, email support@personalizedcatgifts.com with the subject “DMCA Notice”, or write to the address below. Your notice must include: (a) your physical or electronic signature; (b) a description of the copyrighted work; (c) the URL of the content you believe is infringing; (d) your name, address, phone number and email address; (e) a statement that you have a good-faith belief that the use isn’t authorized by the copyright owner, its agent or the law; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner. If your content was removed, you may send a counter-notice with the information required by 17 U.S.C. § 512(g). Knowingly false claims may lead to liability for damages.

10. Disclaimers

Except as stated in our policies and to the extent permitted by law, the Site and its content are provided “as is” and “as available”. Articles and guides on the Site are general information only and are not veterinary, medical or professional advice. Nothing in these Terms limits any warranty or right that can’t be limited under applicable consumer protection law.

11. Limitation of liability

To the fullest extent permitted by law, we aren’t liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Site or our products. Our total liability for any claim relating to an order won’t exceed the amount you paid for that order. Some states don’t allow these limitations, so they may not apply to you.

12. Indemnity

You agree to cover our reasonable losses and costs, including reasonable legal fees, that result from your breach of these Terms or from content you upload that infringes someone else’s rights.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware and applicable US federal law, without regard to conflict-of-law rules. If you have a problem, please contact us first at support@personalizedcatgifts.com; most issues can be resolved quickly and informally. If a dispute can’t be resolved within 30 days, either of us may bring a claim in the state or federal courts located in Delaware, and you and we consent to their jurisdiction. Either of us may instead bring an individual claim in small claims court where you live, if it qualifies. Nothing in this section limits any rights you have under the consumer protection laws of your state.

14. Changes to these Terms

We may update these Terms from time to time. The version in effect when you place an order applies to that order. The date at the top of this page shows when these Terms were last changed.

15. General

If any part of these Terms is found unenforceable, the rest stays in effect. If we don’t enforce a provision, that isn’t a waiver. These Terms and the policies they refer to are the entire agreement between you and us about the Site and your orders.
